Industry Ministry gets temporary minister

Though, the cabinet gets full shape today, nearly three months after formation of new government, the Industry Ministry gets a temporary minister.

Prime Minister Sher Bahadur Deuba has expanded his cabinet, after 88 days from his assumption of the office following the Supreme Court's ruling. Deuba assumed office on July 13 as per a Supreme Court’s order on July 12, which had also ousted KP Sharma Oli as prime minister and restored the House of Representatives, which was dissolved by Oli on May 21.

But Deuba has appointed Gajendra Bahadur Hamal, who is not a parliamentarian, as the minister for Industry and Commerce Ministry. Hamal’s name had courted controversy over allegations that he was picked from the quota of Chief Justice Cholendra Shumsher Rana. Since Hamal is not a member of the Federal Parliament, he can be minister only for six months.

According to the Constitution, any Nepali can become a minister for six months but then one has to be the member of federal parliament -- either lower or upper House -- to continue as the minister. Thus, Hamal can be industry and commerce minister for only six months. The business community has been waiting for a ministry on whom it can trust but the incumbent government led by Sher Bahadur Deuba has appointment a temporary minister, who needs to boost the confidence of the private sector. The private sector has lost its confidence due to prolonged Corona pandemic.

The coalition cabinet, which had previously inducted only four minister, three from the Nepali Congress (NC) and two from the CPN-Maoist Center, has now members from CPN-Unified Socialist and Janata Samajwadi Party Nepal.

The prime minister also reshuffled the portfolios of some ministers in his cabinet. Gyandendra Bahadur Karki has been shifted to Ministry of Communication, Information and Technology from the Ministry of Law, Justice and Parliamentary Affairs, whereas state minister for health Umesh Shrestha has been shifted to the Office of the Prime Minister and Council of Ministers.

Prime Minister Deuba has appointed 16 new ministers and two state ministers, according to a press note issued by the Office of the President.

President Bidya Devi Bhandari has expanded the Cabinet according to the recommendation of the prime minister under Article 76 and its sub-article (9) and Article 78 and its sub-article (1), the press note issued by the Office of the President reads.

Nepal hopes to see democratic and constitutional process restored soon in Myanmar

 Though, government itself is under scrutiny for its unconstitutional move, it has expressed hope that the democratic and constitutional process in Myanmar will be restored soon.

Issuing a press note in response to the military takeover in Myanmar today, the Foreign Ministry said that Nepal has been closely following the recent developments in Myanmar. “We believe that all parties involved will respect the will of the Myanmar people and hope that the democratic and constitutional process will be restored soon,” the press note reads, adding that Nepal is equally concerned about the safety and wellbeing of the detained civilian leaders including president U Win Myint and State Counsellor Daw Aung San Suu Kyi. “We call for their immediate release.”

Suu Kyi, along with other leaders of her National League for Democracy party, were detained by the military in early morning raids.

The army, however, claimed that it had carried out the detentions in response to ‘election fraud’, handing power to military chief Min Aung Hlaing and imposing a state of emergency for one year, according to a statement on a military-owned television station. 

Governments and international organisations immediately denounced the military coup, saying it sets back the limited democratic reforms Myanmar has made. The United Nations said the developments (in Myanmar) were a ‘serious blow to democratic reforms’ and urged all leaders to refrain from violence and respect human rights. The United States, Britain, Australia and the European Union condemned the military’s coup and detentions and its declaration of a state of emergency. India also said it expresses ‘deep concern’ over the reports of an unfolding military coup in Myanmar. However, China said it ‘noted’ what happened in Myanmar.

The Military coup in Myanmar today, however, comes as a grim reminder for Nepalis of a royal coup exactly 16 years ago on February 1, 2005, when the then king Gyanendra had assumed absolute power, declared himself the chair of the council of ministers and put political party leaders in house arrest. Then King Gyanendra had also cut off telephone and internet connections and declared a state of emergency like the Myanmar military ruler did today. The media was also put under military censorship and army men took over the newsroom of the media houses in Kathmandu.

Apart from media censorship, Myanmar’s military has also taken control of the country under a one-year state of emergency. The announcement on military-owned Myawaddy TV cited Article 417 of the country’s constitution, which allows the military to take over in times of emergency. The announcer said the coronavirus crisis and the government’s failure to postpone November elections were reasons for the emergency. The military drafted the constitution in 2008 and retains power under the charter at the expense of democratic and civilian rule. Human Rights Watch has described the clause as a ‘coup mechanism in waiting.’

The constitution also reserves key cabinet ministries and 25 per cent of the seats in Parliament for the military, a portion that limits the power of a civilian government and rules out amending the charter without military support. 

In November elections, Suu Kyi’s party captured 396 out of 476 seats in the combined lower and upper houses of Parliament. The state Union Election Commission has confirmed the result but the military claimed there were millions of irregularities in voter lists in 314 townships that could have let voters cast multiple ballots or commit other ‘voting malpractice.’

Immediately after the coup notice, residents flocked to ATMs and food vendors, while some shops and homes removed the symbols of Suu Kyi’s party, the National League for Democracy, that typically adorn the streets and walls of the city.

राजनीतिले बन्धक बनाएको अर्थतन्त्र

नेपाली अर्थतन्त्र फेरि एकपटक ‘गलत राजनीति’को बन्धक भएको छ । इतिहासमा पटकपटक गरेका तथा भएका अरुका गल्तीबाट नसिकी सहज बहुमतप्राप्त सरकारको अल्पायु मरण रोजेका प्रधानमन्त्री केपी शर्मा ओलीले नेपाललाई राजनीतिक अस्थिरताको भूमरीमा लाँदै गर्दा यसले अर्थतन्त्रमा पार्ने असरको बारेमा आकलन गरेनन् वा गर्न आवश्यकता ठानेनन् ।

कोरोना कहरबाट विस्तारै तङ्ग्रिन लागेको अर्थतन्त्रमा निर्मम प्रहार हुने गरी प्रधानमन्त्रीले आफूलाई पाँच वर्षे कार्यकाल आवश्यक नभएको झैं गरी हठात्् करिब तीन वर्षमा नै संसद् विघटन गरिदिँदा लगानीकर्ताको मनोबलमा पर्ने असरबारे नसोचेको भए पनि वर्तमान सरकारमाथि विदेशी लगानीकर्ताको विश्वास भने पहिले पनि नभएको अर्थशास्त्रीहरूको बुझाइ छ ।

अर्थशास्त्री रामेश्वर खनालका अनुसार विदेशी लगानीकर्ताले यसै पनि वर्तमान सरकारलाई त्यति विश्वास गरेका थिएनन् । “गएको चुनावदेखि नै राजनीतिक स्थिरता भए पनि विदेशी लगानीकर्ताहरू ओली सरकारसँग विश्वस्त हुन सकेका थिएनन्,” उनी भन्छन्, “त्यसैले आइतबारको घटनाबाट खासै थप प्रभाव नपर्ला ।”

खनालका अनुसार स्वदेशी लगानीकर्ताको हकमा भने यदि सरकारले तोकेकै समयमा चुनाव गरे बरु केही राहत हुनसक्छ । चुनावसँग सम्बन्धित खर्च हुँदा बरु रेष्टुरेन्ट, होटेल तथा निर्वाचनसँग सम्बन्धित साना व्यवासायलाई फाइदा हुनसक्छ भन्दै उनी थप्छन्, “चुनावका कारण निर्माण क्षेत्रमा सकारात्मक प्रभाव पर्न सक्छ, किनकी चुनाव जित्न पनि उम्मेदवारले आफ्ना पालिकाका प्रमुखहरूलाई काम गरेर देखाउन दबाब सिर्जना गर्नेछन् ।” यसबाट कोरोनाका कारण भएको निर्माण क्षेत्रको घाटा परिपूर्ति हुनसक्ने उनको विचार छ । 

नेपाली नागरिकको समृद्धिको चाहनामा कुठाराघात गर्दै प्रधानमन्त्री केपी शर्मा ओलीले आइतबार फेरि राजनीतिक अस्थिरताको सुरुवात गरेको भए पनि निजीक्षेत्रलाई यसबाट राहत हुनसक्ने आकलन पनि रहेको छ । 

“सरकार अब चुनावमा व्यस्त हुँदा निजी क्षेत्रलाई काम गर्न सहज हुन्छ,” खनाल भन्छन्, “अझ ओली सरकार निजीक्षेत्रलाई केही राहत दिएरै भए पनि चुनाव जित्नका लागि नीतिगतरूपमा खुकुलो व्यवहार गर्न सक्छ ।” 

तर, चुनाव सरकारले तोके झैं वैशाख १७ र २७ मा नै हुन्छ कि हुन्न, त्यसबाट पनि अर्थतन्त्र कता जान्छ वा लगानीकर्ताको मनोबाल झन् खस्कन्छ कि उठ्छ मेसो पाइने अर्का अर्थशास्त्री विश्व पौडेलको बुझाइ छ । 

पौडेलका अनुसार नीतिगत अस्थिरताले दीर्घकालीन लागानीमा असर पर्छ नै । नीतिगत अस्थिरताले न्यून लगानी भिœयाउने हुँदा सरकारले समयमा नै चुनाव गर्न सके केही राहत हुनसक्ने उनको आकलन छ । “यदि चुनावपछि बहुमतको सरकार बने, फेरि लगानीको वातावरण बन्ला, तर विगतका वर्षहरूमा झैँ मिलिजुली सरकार बनाउने वातावरण बन्यो भने फेरि उत्साहजनक वातावरण भने बन्दैन,” उनी थप्छन् । 

कोरोना कहरका कारण गत आर्थिक वर्षदेखि नै करिब करिब बन्द अवस्थामा रहेका उद्योग विस्तारै खुल्दै गर्दा हठात् राजनीतिक वातावरण परिवर्तन हुँदा निजी क्षेत्र भने किकर्तब्यबिमुढ भएको छ । बदलिँदो राजनीतिक अवस्थाले पार्नसक्ने प्रभावबारे धेरै उद्योगी व्यवसायीहरू बोल्नै चाहन्नन् ।

Most of the local levels fail to bring law to protect consumers

 Some 746 local governments have yet not brought Consumers Protection Act, though the Constitution has given them the right to bring the law to protect consumer, according to the chair of the Consumer Welfare Protection Forum Jyoti Baniya, speaking at a programme today.

Highlighting the need to enforce Local Market Management Act as provisioned in the Constitution, he said that the Constitution has also recognised consumers’ welfare under the fundamental right providing sufficient grounds to enforce effective measures to protect their rights. ”The local governments’ apathy to introduce necessary laws has left consumers helpless across the country.”

Although it has been almost five years since the new constitution was endorsed – in 2015 – and the local governments had their elected representatives a year later, only 7 local governments – out of a total 753 – including Damak, Kalaiya, Bhimeshwor, Waling, Tansen, Birendranagar and Tikapur municipalities have so far brought the Act. The law paves way for forming a powerful committee under leadership of the deputy mayor, Baniya added.

The law delegates full authority to the committee to oversee almost all market related activities that include cross inspection, provision of selling points and budget management to conduct research and raise awareness among general people. Each of these 7 municipalities are reported to have allocated up to Rs 5 million to carry out these activities.

The delay in formulating necessary laws by the local governments has created severe problem in effective market inspection and monitoring,” he said, adding that the market inspection being conducted by mayor, deputy mayor or high ranking government officials, in the absence of necessary law have failed to provide any relief to the consumers. “The market, however, has become largely unsafe for consumers as they are being cheated.”

The concern for consumers’ right protection started in Nepal some two-and-a-half decades ago.

Prohibitory order in Kathmandu valley extended with relaxation on development works

 The District Administration Offices of the three districts in Kathmandu valley decided to further extend the prohibitory order for yet another week, though they have vowed to relax development works.

A virtual meeting of the Chief District Officers (CDOs) of Kathmandu, Bhaktapur and Lalitpur – after consulting with the Home Ministry – decided to extend the ban on movement for the third time.

But, they said that the time frame for purchasing essential goods has also been extended till 11am from the previous 9am. The authorities have also allowed shops and vehicles related to development works from 2pm to 9pm. “National pride projects and industries related to essential services can also operate by setting up quarantine facilities,” a press note issued by the Kathmandu district CDO reads. 

The CDOs have, however, changed the modality of prohibitory order at the request of the private sector. The private sector had recommended partial lifting of the prohibitory order to make people lives easier as they have been facing hardship due to absolute closure of all kinds of activities in last 15 days.

“Due to sharp spike in number of daily cases in the valley with a huge concentration of active cases,” the CDOs decided to extend the prohibitory order for another week,” the press note reads.

Earlier, the CDOs of the three districts in the valley had issued prohibitory order on August 19 and extended on August 27 again. “Prohibitory orders in Kathmandu Valley have once again been extended by another week–until September 9 midnight,” CDO of Lalitpur Narayan Prasad Bhatta said, adding that they are trying to make the restrictions more effective. “A standard for online home delivery is being prepared and home delivery will be allowed with strict implementation of the health protocol,” he said, adding that anyone wishing to enter the Valley for emergency work must have the coronavirus RT PCR negative report. “

Likewise, the local administrations in the Valley have also instructed the ward committee offices to monitor whether the people whose swabs have been taken for the coronavirus test and those on the list of contact tracing are living in home isolation. ““Those violating home quarantine rules will be punished as per the Infectious Disease Act 1964.”

UN condemns Dalit killings, calls for independent investigation

UN High Commissioner for Human Rights Michelle Bachelet expressed shock today at the killing of five men by opponents of an inter-caste relationship in Nepal last weekend, as well as several other incidents of caste-based discrimination and violence that have taken place during the Covid-19 pandemic.
“It is distressing that caste-based prejudices remain deeply entrenched in our world in the 21st century, and I am filled with sadness for these two young people who held high hopes of building a life together despite the obstacles presented by their accident of birth,” Bachelet said, adding that caste-based discrimination remains widespread, not only in Nepal but other countries, and often leads to serious harm and, as in this case, even loss of life. “Ending caste-based discrimination is fundamental to the sustainable development vision of leaving no one behind.”
On May 23, a 21-year-old Dalit man Nawaraj BK and a group of his friends from Jajarkot district travelled to Western Rukum district in Karnali province, the home of Nawaraj’s girlfriend, who belonged to a so-called ‘dominant’ higher caste group. They intended to escort the young woman back to their home district, allegedly at her request, but were attacked and chased into a river. Five men, four of whom including Nawaraj were Dalits, were later found dead while another person is still missing.
Extremely disturbing reports are also emerging about a 12-year-old Dalit girl, who was killed in a separate attack in Devdaha village of Rupandehi district. She is said to have been forcibly married to her alleged rapist from a dominant caste. The girl’s body was reportedly discovered hanging from a tree on May 23.
Bachelet called for an independent investigation into the attacks. She stressed that the victims and their families have the right to justice, truth and reparations.
Dalits are seen to be on the lowest rung of the caste hierarchy in Nepali society, traditionally discriminated against as ‘untouchables’.
The honour killings of Dalit youths in Rukum –the birthplace of Maoists insurgency that claimed to change the caste-based society order – has been raised in the Parliament also. The killings have sparked outrage in Nepal, prompting the Federal Ministry of Home Affairs to establish a five-member ‘high-level investigation committee’ to look into the incident. On May 26, police filed a complaint against 20 alleged perpetrators.
“Despite constitutional guarantees, impunity for caste-based discrimination and violence remains high in Nepal,” the UN human rights chief said, adding that Nepal has taken big strides to address this scourge, but so much more can and must be done to eradicate this blight on society. “This is especially the case when the Covid-19 pandemic has increased their vulnerability.”
Since the start of the Covid-19 lockdown, Dalit activists and journalists have reported several cases of caste-based discrimination, incidents of rape, assault, denial of funeral rites and discrimination at quarantine sites.
On May 25, the Parliament’s Law, Justice and Human Rights Committee directed the Ministry of Home Affairs to investigate all incidents of caste-based discrimination and violence during the Covid-19 lockdown. The parliamentary committee asked authorities to immediately investigate two cases of gang-rape of Dalit women, as well as other caste-based cases involving murder, enforced disappearances and forced abortion.
Nepal is a state party to the Convention on the Elimination of All Forms of Racial Discrimination, one of the core international human rights treaties. After its last review in May 2018, the Committee tasked with monitoring the treaty observed that despite the abolition of ‘untouchability’ in Nepal, Dalits continue to face deep-rooted discrimination. It also raised several concerns about issues around inter-caste marriages.
Dalits in Nepal and other countries experience discrimination at every level of their daily lives, limiting their employment and educational opportunities, the places where they can collect water or worship, and their choice of who to marry. Structural barriers and discrimination force Dalits to continue low-income and dehumanising employment, such as manual scavenging, disposing of dead animals, digging graves or making leather products, reads a press note issued by the UN Office in Kathmandu.

DCCs, local levels told not to accept foreign aid without approval

The Ministry of Federal Affairs and General Administration has issued a circular to all district coordination committees (DCC) and local levels not to accept assistance or loans from foreign agencies, development partners, communities or investors without consent of the federal government.
In a response to a letter from the Finance Ministry citing a recent decision of the cabinet, the ministry has urged DCC and local levels to abide by the constitutional provisions and other existing laws related to exclusive and concurrent powers of all three tiers of government.
The constitution – Article 59 (6) – reads that the Government of Nepal shall have power to obtain foreign assistance and borrow loans, which means only the federal government has the right to accept the foreign assistance and borrow loans. “Such assistance or loans shall be obtained or borrowed to maintain macroeconomic stability of the country,” the article reads, adding that Clause 7 of Schedule-5 has set down the matters related to international treaties or agreements, extradition, mutual legal assistance and international borders and transboundary rivers as the exclusive power of the federal government.
According to Section 12 of the Inter-governmental Fiscal Arrangement Act-2017, provincial and local governments shall not obtain any form of foreign grant or assistance or implement or make to implement any plans or programmes with the foreign grants or assistance, without prior consent of the federal government, the circular reads.
The Finance Ministry has requested the Ministry of Federal Affairs and General Administration to issue a circular to all the DCC and local levels in conformance with the November 15 decision of the cabinet, citing that there was the possibility that foreign assistance and loans would be accepted without bringing it to the knowledge of the federal government,” according to the Development Assistance Coordination Section under the Ministry of Federal Affairs and General Administration.
The central government has became very cautious about the issue after some local levels were found to be planning to sign agreements with foreign development partners for assistance and loans by keeping the federal government in the dark.
The federal government can accept foreign grants and assistance for plans or programmes to be implemented by the provincial and local governments.

आर्थिक स्वतन्त्रता र संविधान दिवस


  • ऊर्जा, जलस्रोत तथा सिँचाइ मन्त्रालयले आफैंले ल्याएको नेपाल विद्युत् नियमन ऐनको व्यवस्थाविपरीत विद्युत् विधेयकको मस्यौदा ल्याएको छ । मन्त्रालयले आन्तरिकरूपमा तयार गरेर २४ भदौमा प्रतिक्रियाका लागि सार्वजनिक गरेको विद्युत्सम्बन्धी कानुनलाई संशोधन र एकीकरण गर्न बनेको विधेयकको मस्यौदामा नियमन आयोगको अधिकार कटौती गर्दै मस्यौदा ल्याएको हो । मस्यौदालाई निजी क्षेत्रका जलविद्युत् प्रबन्धकहरूले समेत ‘निरंकुश’ भएको टिप्पणी गरेका छन् । पछिल्लो समय निजी क्षेत्रका जलविद्युत् आयोजनाले नेपालको विद्युत्को माग पूरा गर्न धेरै मद्दत गरेका छन् । तर, सरकार उनीहरूप्रति नै कठोर बन्दै उनीहरूको लगानी डुबाउने खेलमा लागेको छ ।


  • अर्थमन्त्री डा. युवराज खतिवडाले प्रतिनिधिसभामा पेस गरेको नेपाल राष्ट्र बैंक ऐन, २०५८ को संशोधन विधेयक जस्ताको तस्तै पारित भए नेपाल राष्ट्र बैंकको स्वायत्तता खोसिने भएको छ । लामो छलफल तथा बहसपछि २०५८ सालमा नेपाल राष्ट्र बैंक ऐन ल्याएर राष्ट्र बैंकलाई स्वायत्तता दिइएको थियो, जसका कारण आज नेपालमा वित्तीय स्थायित्व छ र बैंक तथा वित्तीय संस्थाहरू अन्य क्षेत्रको तुलनामा प्रतिस्पर्धी तथा पारदर्शी छन् । साथै, सर्वसाधारण बचतकर्तामा बैंक तथा वित्तीय संस्थाप्रति विश्वास हुनुमा राष्ट्र बैंकको स्वायत्तता एउटा प्रमुख कारण हो । सरकारले जुनसुकै बहानामा गभर्नर हटाउन सक्ने प्रावधानले वित्तीय स्थायित्वमा नै असर पार्ने देखिन्छ र भोलिका दिनमा ‘डमी’ गभर्नर राखेर अर्थमन्त्रालयले केन्द्रीय बैंक चलाउने स्थिति निम्त्याउने खतरा देखिन्छ । 


वर्तमान सरकारले कसरी आफैंले बनाएका संस्थाहरू आफैं भुत्ते बनाउन खोज्दैछ भन्ने माथिका दुई उदाहरणले प्रस्ट पार्छ । स्थापित संस्थाहरू ध्वस्त पार्ने तथा नयाँ संरचनामा आफ्ना कार्यकर्ता भर्ती गर्ने गरी संस्थागत रूपमै नेपालको अर्थतन्त्रमा प्रहार भइरहेको उदाहरण पनि हुन् यिनीहरू । पछिल्लो समय नेपालमा बैंक तथा वित्तीय संस्था तथा जलविद्युत् आयोजना देशका लागि अत्यन्त आवश्यक तथा प्रतिफल पनि राम्रै दिइरहेका क्षेत्र हुन् । सरकारको लगानीबिना नै यी क्षेत्रले अर्थतन्त्रमा राम्रो योगदान मात्र दिएका छैनन्, नाफा गरेर आफैं मात्र नखाएर सेयरहोल्डरहरूलाई समेत प्रतिफल बाँडेर समाजवादउन्मुख अर्थतन्त्र बनाउन साथ पनि दिइरहेका छन् ।
तर, उनीहरू नै समाजवादउन्मुख दुईतिहाई सरकारको वक्रदृष्टिमा परेका छन् । नियामकीय स्वायत्तता खोसेर नियमनकारी निकायलाई भुत्ते बनाउँदा बजारमा नक्कली पुँजीवाद तथा नक्कली समाजवाद हावी हुन् गई अर्थतन्त्र धरापमा पर्छ भन्ने कुराको ज्ञान हुन अर्थशास्त्रमा विद्यावारिधि गर्नु पर्दैन, विगत एक दशकको हाम्रै बजारको क्रियाकलाप तथा त्यसका नतिजा हेरे पुग्छ । यसबाट नेपालको अर्थतन्त्रलाई कता डो-याइँदैछ, त्यसको छनक पाइन्छ । संविधानमा नै सरकार, निजी क्षेत्र र सहकारी अर्थतन्त्रका तीन खम्बा भनेर लेखिएपछि सरकारले निजी क्षेत्रलाई कसरी हेर्ने भन्ने कुरामा कुनै संशय नहुनुपर्ने हो ।
निजी क्षेत्रप्रति सरकारको आशक्ति पनि बेलाबेलामा प्रकट हुन्छ, तर निजी क्षेत्रले नै लाज मान्ने गरी प्रकट भएका यस्ता आशक्तिले निजी क्षेत्रलाई अर्थतन्त्रको खम्बा होइन, दलाल पुँजीवादको विकृत रूपमा प्रकटित गरिदिएका उदाहरणहरू पछिल्ला वर्षमा धेरै छन् । यसैगरी संसारको उत्कृष्ट प्रजातान्त्रिक व्यवस्था अर्थात् संघीय लोकतान्त्रिक गणतन्त्र अँगालेको नेपालमा मन्त्रीपिच्छे निजी क्षेत्रलाई हेर्ने दृष्टिकोण पनि फरक–फरक छ । निजी क्षेत्रलाई बजारमा प्रतिस्पर्धात्मक ढंगले काम गर्न दिने र सरकारले नियमन गर्ने हो भने नियमनकारी निकायलाई स्वायत्त बनाउनु पहिलो सर्त हो ।
यदि बिमा समिति, नेपाल धितोपत्र बोर्डजस्ता नियमनकारी निकायलाई स्वायत्तता नदिने र राष्ट्र बैंकजस्ता स्वायत्त निकायलाई पनि अर्थमन्त्रालयको शाखाझैं व्यवहार गर्ने हो भने संविधानमा लेखिएको समाजवादउन्मुख अर्थतन्त्रको निर्माण गर्न सरकार शतप्रतिशत असफल हुने निश्चित छ । दुईतिहाइको सरकारले व्यवसायीका कुनै एक झुन्डका कुरा सुनेर नियमनकारी निकायलाई भुत्ते बनाउने प्रयास गरेको हो भने पनि बेलैमा सोचौं, यो नेपाली जनताले दशकौंसम्म लडेर ल्याएको संविधानप्रति ठूलो धोका हुनेछ । उखानै छ, ल्हासा जानु कुतिको बाटो, अर्थात् समाजवादउन्मुख अर्थतन्त्र बनाउन सरकार पुँजी निर्माण र वितरणको कस्तो मोडल बनाउँदैछ र कस्तो मोडलमा काम गरिरहेछ, त्यसैले नेपालमा लोकतान्त्रिक गणतन्त्रप्रति जनताको वितृष्णा बढ्छ वा घट्छ ।
तर, सरकार भ्रष्टाचारजस्ता सामाजिक बिमारीको उपचार गरेर जनताको मन जित्नु त कता हो कता, झन् भ्रष्टाचारमार्फत कमाएको कालोधन सेतो बनाउन समाजवादको नाममा नक्कली समाजवादको प्रयोग गर्दैछ । यसै मेसोमा निजी क्षेत्रलाई पनि सरकार आफ्नै अनुकूल प्रयोग गर्न नियमनकारी निकायको स्वायत्तता हरण गर्न उद्यत देखिएको छ । त्यसैले नेपालको इतिहासकै सबैभन्दा शक्तिशाली सरकारले विभिन्न काल्पनिक शत्रु खडा गरेर गणतन्त्रमाथि खतरा छ भन्दै हिँड्नुको साटो संविधानको पूर्ण पालना गर्न तथा गराउन लाग्दा नै ‘सुखी नेपाली समृद्ध नेपाल’ को नारा सफल होला । संविधानको पालना भनेको संविधानमा लेखिएका समाजवादउन्मुख अर्थतन्त्र निर्माण गर्ने तथा संविधानले प्रत्याभूत गरेको हरेक नेपालीको आर्थिक स्वतन्त्रता सुनिश्चित गर्ने हो, जसको अर्थ प्रत्येक नेपाली समाजलाई हानि नहुने तथा गैरकानुनीबाहेक आफूले चाहेको पेसा–व्यवसाय गर्न स्वतन्त्र छन् ।
उनीहरूको लगानीको सुरक्षा हुनुप-यो, तर दुर्भाग्य ! सरकार जनताको जीउज्यानको तथा धन सम्पत्तिको रक्षा गर्न पनि असमर्थ देखिएको छ । संविधानले प्रत्याभूत गरेको अधिकारको रक्षा गर्ने दायित्व सरकारको हो, किनकि सरकार संविधानको संरक्षक पनि हो । तर सरकार आफैं संविधान मिच्दै अर्थतन्त्रका खम्बाहरूको दुरुपयोगतर्फ अग्रसर भइरहेको छ । सहकारीलाई राजनीतिक हतियार बनाएर सोझासाझा जनता ठग्ने हतियार बनाइँदा सरकार मूकदर्शक छ । निजी क्षेत्रका नाममा रातारात नामै नसुनेका समूहले अर्बौं लगानी गर्दा सरकारले देख्दैन । तर, वर्षौंदेखि नेपालमा लगानी गरिरहेका लगानीकर्तालाई हतोत्साही बनाउन कुनै कसर छोड्दैन । वास्तविक निजी क्षेत्र पीडित छ, तर रातारात उदाएका बिचौलिया बालुवाटार पुगेर आफ्नो अनुकुल नीतिनियम बनाउन सक्छ ।
यसरी जस्केलाबाट आएका लगानी तथा लगानीकर्ताले अर्थतन्त्र नै डुबाउने खतरा एकातिर छ भने अर्कातिर नेपालमा व्यावसायिक वातावरण नभएपछि लगानीकर्ता कुरेर बस्दैनन् र बिस्तारै पलायन हुन्छन् । विगतमा सबै राजनीतिक दलले भन्दै आएको र मान्दै आएको कुरा के पनि हो भने राजनीतिक मुद्दा समाधानपछि मात्र अर्थतन्त्रले गति लिन्छ । राजनीतिक मुद्दा संघीय गणतन्त्र संबिधान जारी गरेकै दिन छिनोफानो भइसक्यो । अब केही मुद्दा बाँकी भए संविधान भनेको कुनै अपरिवर्तनीय दस्तावेज होइन, संशोधन गर्न सकिन्छ ।
तर, २०७२ साल असोज ३ गतेदेखि पछिल्ला चार वर्षमा बाग्मतीमा धेरै पानी बगिसकेको छ । नेपालीको जीवनस्तरमा देखिने गरी केही परिवर्तन आएको छैन । विगत सात दशकदेखि नेपालीले आशा गरेको राजनीतिक स्थिरता त पाए, तर सरकारको भाषणबाहेक कतै आर्थिक क्रान्तिको नामोनिसान भेटिएको छैन । केही नेताका, केही कर्मचारीका, केही राजनीतिक बिचौलियका जीवनमा जनताले देखिने गरी नै आर्थिक क्रान्ति आएको देखिन्छ । तर, दशकौंदेखि न्याय, समानता तथा आर्थिक स्वतन्त्रताका लागि लडेका लाखौं नेपालीको जीवनस्तरमा देखिने गरी सुधार नआएसम्म जतिसुकै काल्पनिक पात्र खडा गरेर हावामा विरोध गरे पनि सरकार तथा व्यवस्थाप्रति जनताको वितृष्णा बढ्ने नै देखिन्छ, घट्ने देखिन्न ।
त्यसैले संविधानमा लेखिएको समाजवादउन्मुख अर्थतन्त्र निर्माण गर्ने बाटोमा लाग्ने हो भने सरकारले ढिलो नगरी निजी क्षेत्रलाई निगाहमा होइन, प्रतिस्पर्धी तथा पारदर्शी ढंगले काम गर्ने वातावरण बनाउनुप-यो । यसका लागि संसद्मा पेस भएका अर्थतन्त्रसम्बन्धी बिमासम्बन्धी कानुनलाई संशोधन र एकीकरण गर्न बनेको विधेयक, सूचना प्रविधिको सम्बन्धमा व्यवस्था गर्न बनेको विधेयक, धितोपत्र सम्बन्धी ऐन, २०६३ लाई संशोधन गर्न बनेको विधेयक, नेपाल राष्ट्र बैंक ऐन, २०५८ लाई संशोधन गर्न बनेको विधेयक, बैंक तथा वित्तीय संस्थासम्बन्धी ऐन, २०७३ लाई संशोधन गर्न बनेको विधेयक, औद्योगिक व्यवसायसम्बन्धी प्रचलित कानुनलाई संशोधन र एकीकरण गर्न बनेको विधेयक, औद्योगिक व्यवसाय विकास प्रतिष्ठान ऐन, २०५३ लाई संशोधन गर्न बनेको विधेयकजस्ता करिब दुई दर्जन विधेयकलाई परिमार्जनसहित बृहत् छलफल गरेर नियामकीय संस्थाहरूलाई नीतिगत तथा कानुनी हतियारसहित स्वायत्त बनाएर मात्रै पास गर्दा होला ।
अन्यथा स्थिर सरकारकै कारण अर्थतन्त्र भने वर्षांैसम्म अस्थिर हुन गए इतिहासले त मूल्यांकन गर्ला नै, वर्तमानमा नै पनि सरकारका असक्षमताको कारण व्यवस्थाप्रति वितृष्णा बढ्न जाने देखिन्छ । यसबाट सरकारमा रहेको दलमात्र होइन, नेपाली समाज तथा देशमा सामाजिक विग्रह हुने लक्षण पछिल्ला केही घटनाहरूले देखाइसकेका छन् । संविधान कार्यान्वयन गर्न सरकारमा रहेको दलको जिम्मेवारी बढी हुन्छ, हावामा मुक्का चलाउनुभन्दा बेलैमा हेक्का राखेको राम्रो !

Poudel in fiscal commission, Subedi in inclusive commission

The Constitutional Council (CC) today has recommended names for the head of five constitutional bodies, as government had promised to appoint these vacant posts within January 15.
The meeting of the CC has recommended the name of former secretary Bala Nanda Poudel as chairman of National Natural Resources and Fiscal Commission (NNRFC), and former finance secretary Shanta  Raj Subedi for National Inclusion Commission, apart from Dr Bijaya Kumar Dutta for Madhesi Commission,  Bishnu Prasad Tharu for Tharu Commission and Samim Ansari for Muslim Commission.
National Natural Resources and Fiscal Commission is one of the major constitutional organs as its work mainly determine detailed basis and modality for the distribution of revenues between the federal, province and local governments out of the Federal Consolidated Fund in accordance with the Constitution and law and to make recommendation about equalisation grants to be provided to the province and local governments out of the Federal Consolidated Fund. The Constitutional Council is also key to make the fiscal federalism effective without which the federation of the country is not complete.
Likewise, National Inclusion Commission, under Article 258 of the Constitution of Nepal consist a chairperson and four other members, who will study and forward suggestions to government for the protection of rights of and interests of the communities, including Khas Arya, Backward class, persons with disabilities, senior citizens, labours, peasants, minorities and marginalised community.
According to Article 262, under the Constitution of Nepal, Madhesi Commission shall work for the protection of the rights and interests of the Madhesi nationalities. The CC has proposed Bijay Kumar Dutta as Madhesi Commission Chair.
The Tharu Commission, under Article 263 requires to work for protection of rights and interest of Tharu communities. The Constitutional Council has recommended Bishnu Prasad Chaudary as its chair.
Like the Madhesi and Tharu Commissions, the Muslim Commission shall focus its functions and duties to preserve interests of the Muslim community. The CC has recommended Samim Ansari as its chair.
According to the Constitution of Nepal, the President shall, on the recommendation of the Constitutional Council, appoint the chairperson and members of all the constitutional bodies.

वित्तीय संघीयताका चुनौती


मोरङको बूढीगंगा गाउँपालिकाले त्यहाँ रहेका उद्योगलाई विभिन्न शीर्षकमा लगाएको करविरूद्ध मोरङ व्यापार संघले उच्च अदालत विराटनगरमा मुद्दा दायर गरेको छ । व्यापार संघले सोमबार उच्च अदालतमा बूढीगंगा गाउँपालिकाले संविधानविपरीत दोहोरो कर लिएको भन्दै मुद्दा दायर गरेको हो । संघका अध्यक्ष पवनकुमार शारडाका अनुसार बूढीगंगाले त्यहाँका उद्योगमा यस आर्थिक वर्षदेखि लागू हुने गरी विभिन्न शीर्षकमा अत्यधिक मात्रामा छुट्टै व्यवसाय कर लगाएको छ । जसअनुसार ठूला उद्योगलाई ५ लाख, मझौला उद्योगलाई ३ लाख र साना उद्योगलाई १ लाख कर कायम गरेको छ । साथै घर जग्गा करअन्तर्गत उद्योग भवनसमेतको समेत कर दस्तुर लगाइएको छ । रिट निवेदनमा ‘उद्योगहरूले धेरै अगाडिदेखि करसमेत बुझाई कारोबार गर्दै आएकोमा पुनः पटके सवारी कर, विदेशी सवारी साधनमा लाग्ने दस्तुर र कवाडी कर भनी उद्योगका लागि आउने सवारी तथा कवाडीका सामाग्रीमा दोहोरो कर उठाउन आह्वान गरिएको बोलपत्र नै गैरकानुनी’ रहेको दाबी गरिएको छ । बूढीगंगा गाउँपालिकाले कार्यपालिकाको बैठकबाट दररेट पारित गरी फलाममा प्रति केजी २ रूपैयाँ, पित्तल, तामा, फलाम, जिंकलगायतमा प्रति केजी २.५० र काम नलाग्ने मेसिनरी औजारमा प्रति केजी २ रूपैयाँका दरले लगाएको करले उद्योग व्यवसायको लागतमा वृद्धि भएको अध्यक्ष शारडाले बताए ।

बूढीगंगा गाउँपालिकाले लगाएको करको विरुद्ध ब्यवसायीले अदालतमा मुद्दा नै दायर गरेको एउटा प्रतिनिधिमूलक घटना हो यो । संघीय संविधानको लेखनक्रमममा नै निजी क्षेत्रले संघीयता लागू भएपछि दोहोरो कर तथा अन्य विभिन्न करहरूमा एकरूपता ल्याउनु पर्ने मागसहित राजनीतिक दलका शीर्ष नेतृत्वलाई लामो फेहरिस्त नै बुझाएको थियो । पटक–पटक विभिन्न नाममा दोहोरो कर लगाउँदा उद्योगी–व्यवसायीको मनोबल खस्कने र उद्योग व्यवसायको लागत बढ्न गइ धराशायी हुन्छ ।  संविधान तथा कानुनअनुसार पनि सघीय सरकार, प्रदेश सरकार तथा स्थानीय सरकारले एउटै वस्तुमा पटक पटक कानुन नै नबनाई दोहोरो–तेहेरो कर दस्तुर लिनु गैरसंवैधानिक तथा गैरकानुनी पनि हो । तर राजनीतिको विद्यालयबाट संघीयताको पाठ्यक्रम पढेर हुर्किएको हाम्रो स्थानीय तथा प्रदेश एवं संघीय नेतृत्व नै वित्तीय संघीयताको मूल मर्मविपरित संघीयतालाई नै खतरामा पार्ने क्रियाकलापमा व्यस्त छन् । राज्य पुुनःसंरचना तथा भौगोलिक संघीयताको चुरो भनेको वित्तीय संघीयता हो । यदी वित्तीय संघीयताको बारेमा संविधान निर्माणकै क्रममा व्यापक छलफल भएको भएको भए, आज यो विवाद आउँदैनथ्यो होला । तर, संविधान निर्माणका क्रममा भएका सबै नै छलफल केबल राजनीति र भूगोलमा मात्रै केन्द्रित भयो, चुनावलाई केन्द्रबिन्दुमा राखेर राजनीतिक दलले देशमा शासन गर्ने अभिप्रायले नै संविधानको परिकल्पना गरे । त्यसको परिणाम आज प्रदेश, प्रदेशबीच तथा स्थानीय सरकार, स्थानीय सरकारबीच धेरैभन्दा धेरै लगानी तान्ने र औद्योगिकीकरणमा जोड दिनुपर्नेमा अऔद्योगिकिकरण हुने डर फैलिएको छ । निजी क्षेत्रलाई त्रसित बनाउनु भनेको मुलुक अऔद्योगिकीकरणको बाटोमा जानु हो । मोरङको बूढीगंगा गाउँपालिकाको यो घटना एउटा प्रतिनिधिमुलक घटनामात्र हो ।

नेपालमा शदियौंदेखि एउटा वर्गको केन्द्रिकीत शासनसत्ताका कारण राज्यका सबै स्रोत र साधन उनीहरूको कब्जामा रह्यो । जसका कारण देश गरिबी, अभाव, असमानता तथा अविकासको दुष्चक्रमा प-यो । विगत ७० वर्षदेखि नेपालका राजनीतिक दलले नेपाली जनतालाई घोकाउँदै आएको पाठ यही हो । त्यसैले समानुपातिक, न्यायोचित तथा समविकासका लागि संघीयता आवश्यक छ । नेपाली जनताले राजनीतिक दलको पाठ अक्षरशः पालना गरे र एउटा परिवार वा वर्गको हातबाट शासन सत्ता खोसेर आफनै हातले संघीय गणतन्त्र नेपालको संविधान लेखे । तर, राज्यको पुनः संरचना कुुनै पनि देशको विकासका आयामभित्रको एउटा पाटोमात्र हो । समानुपातिक, न्यायोचित तथा समविकासको लागि, त्यसैले, राज्य पुनः संरचना भौगोलिक कार्यमात्र होइन । स्वस्थानी कथामा झैं एउटा घेरा कोरेर तिमी यो राज्यको राजा भयौ भन्नका खातिर हजारौं नेपाली जनताले बलिदान दिएका होइनन् । तर, राज्य पुनःसंरचना तथा त्यसपछिका केन्द्र सरकारका क्रियाकलापमा स्थानीय तथा प्रदेश सरकारको आर्थिक सक्षमता विकास तथा वित्तीय संघीयताको झल्को नपाईदा एउटा वर्गको हातबाट शासन खोसेर अर्को नवकुलिन वर्गको हातमा शासन सत्ता गएको हो कि झैं आभास हुन थालेको छ । किनकी स्थानीय सरकारमा चुनिएका नेताहरू आफना गैर संवैधानिक तथा गैरकानुनी चुनावी वाचा पूरा गर्न आर्थिक अनुशासनहीनता तथा विकृत वित्तीय अनुशासनको अभ्यास गर्दै छन् । मोरङको बूढीगंगा गाउँपालिकाका पानीमाथि उत्रिएको हिउँको एउटा सानो टुक्रामात्र हो । योभन्दा ठूलो आकार पानीमुनि अझैं छोपिएको छ । त्यसको पूर्ण आकारको अनुमान अहिले कसैले गरेको छैन । जब त्यसको पुर्ण आकार देखिन्छ, जनतामा संघीयताप्रति चरम वितृष्णा नजाग्ला भन्ने छैन ।त्यसैले वित्तीय संघीयताको पहिलो ठूलो चुनौती भनेको अझै पनि जनवादी केन्द्रिकृत राज्य सत्ताको धङघङी नै हो । वित्तीय संघीयता कार्यान्वयनको पहिलो चुनौती अहिलेको केन्द्रिकृत कार्यशैली तथा वित्तीय अनुसाशनहिनता नै हो भन्नेमा विज्ञहरु विश्वस्त छन् । अर्थविद् डा. चन्द्रमणि अधिकारी पनि केन्द्रका नेतृत्वको ब्यवहार संघीय प्रणाली अनुरूपको हुनुपर्नेमा जोड दिन्छन् । तीनै तहको सरकारको चुनाव पछि नेपाल संघीयता कार्यान्वयनमा गएको मान्ने हो भने पनि कार्यशैली भने परिवर्तन भएन । केन्द्रले नै सबै निर्णय गर्ने तथा विकासको जिम्मा लिने हो भने, प्रदेश तथा स्थानीय सरकाले कहिले क्षमता अभिवृद्धि गर्ने र संघीयता पूर्ण रूपमा लागू हुने प्रश्न जटिल छ । किनकी विकास भनेको आर्थिक क्षमता वृद्धि मात्र होइन, अपितुु नागरिकको व्यवहारमा आउने समष्टिगत सुुधार हो । संघीयता अनुरूपको व्यवहार नभएसम्म संघीयता अझ त्यसमा पनि वित्तीय संघीयता कार्यान्वयन हुन सक्दैन । समस्या मोरङको बूढीगंगा गाउँपालिका जस्ता अनेकन स्थानीय तहमा छ, त्यता समाधान गर्न लाग्दा ठिक होला न कि गद्दी छोडेर साधारण नागरिक भइसकेका ज्ञानेन्द्रले नाचेको प्रति टिप्पणी गर्दा ।

दोस्रो चुनौती, तीनै तहका सरकारबीच साधन स्रोतको ठाडो तथा तेर्सो सन्तुलित बाँडफाँड हो । वित्तीय संघीयताका विश्वव्यापी सिद्धान्तअनुरूप वित्तीय स्रोतको प्राप्ति र वितरणसँग सम्बन्धित सिद्धान्तहरूमा राजस्व जिम्मेवारीको सिद्धान्त, अन्तरसरकारी हस्तान्तरणको सिद्धान्त, ऋण प्रवाहको सिद्धान्त, वित्तीय व्यवस्थापनको सिद्धान्त नै प्रमुुख हुन् । तर, देशको भूूगोल, उद्योग–व्यवसाय, स्रोत परिचालनका सम्भावना पनि महत्वपूर्ण हुन् । हाल नेपालमा संघीयता महँगो भयो, कर धेरै लगाइयो भन्ने आवाज जताततै छ । अवश्य पनि केन्द्रिकृत राज्य व्यवस्था भन्दा संघीयता महँगो हुन्छ नै । संघीयता महँगो राजनीतिक व्यवस्था भए पनि जथाभावी कर लगाउँदा आइपर्नसक्ने भावी दुुश्परिणामबारे जनप्रतिनिधिहरू अनभिज्ञ देखिएका छन् । पहिला एउटा सरकार भएकोमा हाल केन्द्र, ७ प्रदेश तथा ७५३ स्थानीय सरकार नेपालमा छन् । प्रादेशिक संसद र मन्त्री, संघीय संसद र मन्त्रीलगायत धेरै निकाय तीनै तहमा राखिने व्यवस्था भएकाले संघीयता खर्चिलो हुुनुु स्वाभाविकै पनि हो । त्यसमाथि चुनावपूर्व गरिएका राजनीतिक वाचा पूरा गर्ने नाममा जथाभावी डोजर लगाउने खर्च विभिन्न करका नाममा थप्नु गैरसंवैधानिक तथा गैरकानुनी हो । सिद्धान्ततः कर जहिले पनि र जुनसुकै प्रकृतिको भए पनि न्यूनतम आवश्यकता पूरा भएपछि मात्र लिनुदिनु पर्ने वित्तीय औजार हो । त्यसैले, जनता अब सचेत भइसकेका छन् र वित्तीय औजारको दुरूपयोग बुझ्ने भइसकेका छन् । कर तिर्ने बेलामा उनीहरूले आफूले पाएको सुुविधाको समीक्षा अवश्य पनि गर्दछन् । देशको भूूगोल, आर्थिक क्षमता, पूर्वाधारको क्षमता, जनताको हैसियत आदिलाई हेरेरमात्र कर नलगाउँदा अर्को विद्रोह ननिम्त्याउँला भन्ने छैन । राज्यको आयस्रोतको ठूलो स्रोत भनेको कर राजस्व हो । तर, एकातिर रोजागारी सिर्जना गर्ने तथा कर तिर्ने उद्योगी ब्यापारीलाई त्रसित पार्ने, अर्कोतिर अत्यावश्यक पूर्वाधारको अभावमा नयाँ लगानी नआउने भएपछि भएका सीमित स्रोत पनि नासिने भयो । संघीयतामा केन्द्र, प्रदेश र स्थानीय सबै सरकारले कर लिन पाउने विश्वव्यापी मान्यता छ भन्दैमा बन्द व्यापार उद्योग नै बन्द हुने गरेर स्रोतलाई नै नष्ट, भ्रष्ट गर्ने अभ्यास गर्दा नकारात्मक सन्देश जान्छ र संघीयताप्रति नै वितृष्णा जगाउँछ । संविधानको अनुसूची ६ मा उल्लेख भएको विषयमा प्रदेश र अनुसूची ८ मा उल्लेख भएको विषयमा स्थानीय तहले कर लगाउन पाउँने भएपनि साझा अधिकारको सूचिभित्रका विषयमा र कुनै पनि तहको सूचीमा नपरेका विषयमा राजस्व उठाउने व्यवस्था नेपाल सरकारले निर्धारण गरे बमोजिम हुन्छ नै । तीनै तहलाई आ आफ्नो अधिकारक्षेत्र भित्रको विषयमा राजस्व उठाउने अधिकार पनि छ । तर राजस्व उठाउनेमात्र होइन उठेका राजस्व सदुपयोगको तथा पारदर्शिताको कुरामा पनि ध्यान दिनु आवस्यक हुन्छ । अपुग स्रोत केन्द्रले संकलन गरेको राजस्व संघ, प्रदेश र स्थानीय तहलाई न्यायोचित वितरण गर्नुपर्ने हुन्छ । प्रदेश र स्थानीय तहले प्राप्त गर्ने वित्तीय हस्तान्तरणको परिमाण राष्ट्रिय प्राकृतिक स्रोत तथा वित्त आयोगको सिफारिसमा हुने व्यवस्था समेत संविधानले गरेको छ ।तर, संविधानले सबै अधिकार दिएको छ । आफै व्यवस्था गर भनेर केन्द्रले भन्ने स्थिती हाल छैन । किनकी उनीहरूको क्षमता अभिवृद्धि पनि आवस्यक छ । त्यसबाहेक आवस्यक स्रोत केन्द्र सरकारले प्रदेश र स्थानीय तहलाई राजस्वको क्षमताको आधारमा वित्तीय समानीकरण अनुदान वितरण गर्ने व्यवस्था गरिएको छ । साथै, प्रदेशले नेपाल सरकारबाट प्राप्त अनुदान र आफ्नो स्रोतबाट उठ्ने राजस्वलाई मातहतको स्थानीय तहको खर्चको आवश्यकता र राजस्व क्षमताको आधारमा वित्तीय समानीकरण अनुदान वितरण गर्नु पर्दछ । नेपाल सरकारले संघीय सञ्चित कोषबाट प्रदान गर्ने सशर्त अनुदान, समपूरक अनुदान वा अन्य प्रयोजनका लागि समेत संघीय कानून बमोजिम वितरण गर्न सक्छ । राजस्व बाँडफाँड गर्नेसम्बन्धी कानुन बनाउँदा प्रदेश र स्थानीय तहले जनतालाई प्रदान गर्ने सेवा, राजस्व उठाउन सक्ने क्षमता, विकासको आवश्यकता, गरिवी र असमानताको न्यूनीकरण र बञ्चितीकरणको अन्त्य जस्ता विषयमा ध्यान पुर्याइएको पनि राष्ट्रिय प्राकृतिक स्रोत तथा वित्त आयोगले बताएको छ ।सिद्धान्ततः संघीय प्रणालीमा राजनीतिक र प्रशासकीय अधिकार जस्तैगरी वित्तीय अधिकार समेत संघीय इकाइहरूबीच आपसमा बाँडफाँड गरिन्छ । संघले प्राप्त गरेको आय (राजस्व) लाई प्रदेश र स्थानीय तहसम्म प्रदेश वा स्थानीय तहको क्षमता, आवश्यकता र क्षेत्रीय सन्तुलनसमेतलाई विचार गरी कानून बमोजिम वा संवैधानिक आयोगको व्यवस्था भए सोको सिफारिसमा वितरण गर्नुपर्दछ भन्ने मान्यता अनुसार नै आयोगले वितरणको फर्मुला बनाएको हो । यसरी वितरण गरेको स्रोत के कामको लागि खर्च गर्ने भन्ने अधिकार भने पूर्ण रूपमा प्रदेश वा स्थानीय तहलाई नै हुन्छ । यसो गर उसो गर भनेर हस्तक्षेप गर्न वा निर्देश गर्न पाइदैन । यसरी स्थानीय तहसम्मै स्वतन्त्र रूपले खर्च गर्न पाइने हुँदा क्षेत्रीय असमानताको अन्त्य हुने, बेरोजगारी समस्या घट्ने, राजनीतिक उत्साह र जिम्मेवारीबोध हुने तथा जनजागरणमा सकारात्मक परिणाम प्राप्त हुन्छ भन्ने मान्यता पनि हो । त्यसैले राष्ट्रिय प्राकृतिक स्रोत तथा वित्त आयोग गठन तथा अन्तरसरकारी वित्त व्यवस्थापन ऐनले पनि सरकारका तहहरूबीच राजस्व बाँडफाँड गर्ने सहजीकरण गर्न गर्दछन् । किनकि साथै, बिनास्रोत साधन समानुपातिक, समन्यायिक तथा समविकास पनि चुनावी नारा मात्र हुन्छ । त्यसैले स्थानीय सरकारकै ब्यवहारका कारण अर्को चुनावसम्ममा संघीयताको विरुद्धको जनमत तयार नहोस् भन्नका लागि पनि वित्तीय ब्यवस्थापन महत्वपूर्ण छ । बिना सफल वित्तीय संघीयता कार्यान्वयन नेपाल फेरि अर्को एउटा राजनीतिक प्रयोगशाला नबन्ला भन्ने छैन । इतिहासले नेपालमा प्रत्येक १०, १० वर्षमा पटके राजनीतिक परिवर्तन भएको देखाउँछ । इतिहास नदोहोरिएला भन्ने प्रत्याभुति दिनसक्ने वर्तमान सरकारको कुनै क्षमता छैन ।

अर्थविद् अधिकारीका शब्दमा नेपालको वित्तीय संघीयताको तेस्रो प्रमुख चुनौती भनेको साधन तथा स्रोतको परिचालन र व्यवस्थापन हो । नेपालको संविधान २०७२ ले संघीय, प्रादेशिक र स्थानीय सरकार गरी तीनैवटा सरकार संवैधानिक हकको अधिकार प्रयोग गर्न सक्ने बनाइ दिएको छ । यसैले, सरकार चलाउन खर्चको आवश्यकता पर्ने भएकाले सबै तहका सरकारको ध्यान करको दर र दायरा बढाउनतिर नै गएको देखिन्छ । संविधानको धारा ६० तथा साझा सूची र ५ देखि ९ सम्मका अनुुसूचीहरूले स्थानीय, प्रान्तीय र संघीय सरकारका कार्यक्षेत्र, अधिकार र साझा अधिकार खुलाइदिएको पनि छ । तर, साधन तथा स्रोतको परिचालन र ब्यवस्थापनमा  नेपालको कुनै राम्रो इतिहास छैन । र संघीयतामा सबैभन्दा ठूलो झगडा यसैमा देखिन्छ । यहि साता काठमाडौंमा भएको अन्तर प्रदेश परिषद्को बैठकमा मुख्यमन्त्रीहरूको गुनासो पनि यसैमा थियो ।    संघीय राज्यव्यवस्था र सरकारको महत्वपूर्ण पक्ष नै शक्ति र स्रोतको बाँडफाँड हो । नागरिक हक–अधिकार, निर्वाचन प्रणाली, सरकार–सरकारबीचको अन्तरसम्बन्धजस्ता विषयहरू शक्तिअन्तर्गत पर्छन् भने राज्य सञ्चालन, जनहित र विकास–निर्माणका लागि स्रोत, आम्दानी र राजस्वको बाँडफाँड र निरूपणसम्बन्धी कुरा स्रोतअन्तर्गत पर्छन् । अधिकारमात्र दिने तर आर्थिक स्रोतको सुनिश्चित नहुने भएपछि मुख्यमन्त्रीहरूका गुनासा बढ्दै जानेछ । जसबाट संघीयता विरोधीलाई बल पुग्छ र दशकौंपछि नेपालीले प्राप्त गरेको राजनीतिक स्थिरता पनि खतरामा पर्ने देखिन्छ । किनकि वित्तीय संघीयता भनेको संघीय प्रणालीमा देशका विभिन्न तहका संघीय इकाईबीचको वित्तीय सम्बन्ध हो । त्यसैले संघीयताको सफल कार्यान्वयन गर्न वित्तीय संघीयता अचुक अस्त्र हो । कुनै पनि संघीय मुलुकको सफल कार्यान्वयन गर्न सरकारका तहबीच स्वस्थ, पारदर्शी तथा सन्तुलित वित्तीय व्यवस्था आवश्यक छ । तर, नेपपमा वित्तीय विकेन्द्रीकरणको पक्ष सहज देखिँदैन । स्रोतसाधन र विकासका गतिको हिसाबले विभिन्न सरकारमा ठूलो भिन्नता पाइन्छ । विगतका तथ्यांक हेर्दा नेपालभित्र ६ जिल्लाबाट ८५ प्रतिशत राजस्व संकलन भइ बाँकी ७१ जिल्लामा १५ प्रतिशत मात्र उठ्ने अवस्था छ ।

नेपालको संविधानले सार्वजनिक, निजी र सहकारी क्षेत्रको सहभागिता र स्वतन्त्र विकासमार्फत राष्ट्रिय अर्थतन्त्र सुदृढ गर्न अर्थतन्त्रमा निजी क्षेत्रको भूमिकालाई महत्व दिंदै उपलब्ध साधन र स्रोतको अधिकतम परिचालन गरी आर्थिक समृद्धि हासिल गर्ने लक्ष्य लिएको छ । संविधानले निर्देशित गरेका लक्ष्य हासिल गर्न निजी क्षेत्रको ब्यापक सहभागिताबिना असंभव छ । निजी क्षेको आग्रहमा नै संविधानको धारा २३६ ले अन्तरप्रदेश व्यापारमा वस्तुको ढुवानी वा सेवाको विस्तारमा कुनै किसिमको बाधा अवरोध गर्न वा कुनै कर, शुल्क, दस्तुर वा महशुल लगाउन वा त्यस्तो सेवा वा वस्तुको ढुवानी वा विस्तारमा कुनै किसिमको भेदभाव गर्न नपाइने व्यवस्था गरेको पनि छ । तर पनि ब्यवहारमा कस्ता समस्या आउने छन् हेर्न बाँकी नै छ । यस्तै, हाल खर्च बढिरहेको कारण संघ, प्रदेश र स्थानीय तहको खर्चको व्यवस्थापन गर्न तथा तीनवटै तहको बजेटको स्रोत व्यवस्थापन गर्न अप्ठ्यारो परेकोले के कसो गरेर नयाँ स्रोत जुटाउन सकिन्छ भन्ने ध्याउन्नमा स्थानीय तह लागेको देखिन्छ । त्यसैले राजनीतिक रूपमा स्वतन्त्र भएपनि नेपाली जनताले संविधानले दिएको आर्थिक स्वतन्त्रता पुर्ण उपभोग गर्न पाउनु पर्दछ । आफूले चाहेको पेशा व्यवसाय स्वतन्त्रतापूर्वक गरेर खान पाउने अधिकारमा कुनै पनि तहको सरकारले हस्तक्षेप गर्दा संघीयता संचालनको लागि चाहिने स्रोत सुक्ने र पुँजी पलायन मार्फत अर्थतन्त्र धरासयि हुने खतरा रहन्छ । मोरङको बूढीगंगा गाउँपालिकाको घटना यस्ता विकृत अभ्यासको अन्तिम उदाहरण बनोस् ।

अन्योलमा आर्थिक क्रान्ति

दिगो राजनीतिक स्थायित्व, आर्थिक उन्नति र दह्रो राष्ट्रिय एकतामार्फत मुलुकलाई समृद्धिको बाटोमा अग्रसर गराउने वाचा गरेर संविधानसभाबाट ‘नेपालको संविधान २०७२’ जारी भएको एक वर्ष भएको छ । तर, एक वर्ष बित्दा पनि देश राजनीतिक मुद्दामै अल्झिरहेकाले निजी क्षेत्र र आर्थिक क्रान्ति अझै अन्योलग्रस्त छन् ।
करिब सात दशक लामो राजनीतिक संक्रमणकाल पार गरेर संविधानसभाबाट दुई तिहाइभन्दा बढी मतले अनुमोदन भएको संविधानले सार्वजनिक, निजी र सहकारी क्षेत्रको सहभागिता तथा विकासमार्फत उपलब्ध साधन र स्रोतको अधिकतम परिचालनद्वारा तीव्र आर्थिक वृद्धि हासिल गर्ने जनाएको छ ।
त्यसैले संविधान आउँदा आर्थिक क्रान्ति र समृद्धिको ढोका खोल्ने आशा गरेको निजी क्षेत्र एक वर्षमै अन्योलग्रस्त हुनु भनेको शुभसंकेत भने पक्कै होइन । संविधान आयो, स्थायित्व आएन भन्ने निजी क्षेत्रको गुनासो छ । ‘स्थायित्व नभएकाले आर्थिक क्रान्तिको बाटो अझै खुलेन,’ नेपाल उद्योग वाणिज्य महासंघका अध्यक्ष पशुपति मुरारका भन्छन्, देश अझै पनि राजनीतिक मुद्दाकै वरिपरि घुमिरहेको छ, यसबीच विभिन्न सरकारी निकायबाट निजी क्षेत्रलाई दुःख दिने, दुव्र्यवहार गर्ने काम भइरहेको छ । असहज परिस्थितिबाट थिलथिलो भएका उद्योग–व्यवसायमाथि राजस्व, प्रहरी–प्रशासन लगायत निकायबाट दुःख दिने, दुव्र्यवहार गर्ने कार्य झन् बढिरहेको छ ।’
नयाँ संविधान आएपछि देशमा कानुनी राज हुने र लगानी बढ्ने अपेक्षा गरिएको भए पनि निजी क्षेत्रका लागि आवश्यक लगानीको वातावरणमा सुधार हुन चाहिने प्रमुख तŒव कानुनी राजको कुनै प्रत्याभूति नभएको निजी क्षेत्रको गुनासो छ ।
नेपाल उद्योग परिसंघका अध्यक्ष हरिभक्त शर्मा पनि कानुनी राजको प्रत्याभूति नभई लगानी नबढ्ने बताउँछन् । ‘सबैलाई बराबर कानुन लाग्ने भएपछि मात्र लगानीको वातावरण बन्छ,’ उनी भन्छन् ।
शर्माका अनुसार संविधान त आयो तर यसको कार्यान्वय कहिले र कसरी हुन्छ अझै पत्तो छैन । ‘एक वर्षमा संविधान कार्यान्वयन नै हुन सकेको छैन,’ उनी भन्छन् ।
नेपालमा प्रत्येक राजनीतिक दल तथा प्रधानमन्त्री आर्थिक क्रान्तिको सुरुवात भयो भन्छन् किनकि यो एउटा विकाउ नारा भएको छ । तर, जबसम्म आर्थिक मुद्दाले प्रमुखता पाउँदैन, तबसम्म नाराबाजीले काम नगर्ने उनको विश्लेषण छ । अर्थतन्त्रलाई प्रमुख मुद्दा बनाउन ढिला भइसकेको उनको विचार छ ।   
लगानीको वातावरणमा जसरी कानुन पालना महŒवपूर्ण छ, त्यसैगरी समयसापेक्ष कानुन बनाएर उद्योगी–व्यवसायीलाई लगानी गर्न अभिप्रेरित गर्न पनि आवश्यक छ । एक वर्षबीच केही कानुन पनि नबनेका होइनन् । निजी क्षेत्रले लामो समयदेखि माग गर्दै आएको विशेष आर्थिक क्षेत्र ऐन संसद्बाट पारित भएको छ । तर, उद्योग व्यवसाय सञ्चालनका लागि निजी क्षेत्रले बारम्बार माग गर्दै आएको लगानीमैत्री नयाँ औद्योगिक व्यवसाय ऐन, विदेशी लगानी तथा प्रविधि हस्तान्तरण ऐन, ट्रेड युनियनसँग भएको सहमतिका आधारमा श्रम ऐन बनेका छैनन्, कानुन र कालोबजारी ऐनजस्ता पुराना ऐन  संशोधन भएका छैनन् । अझै पनि विभिन्न माग राख्दै मजदुर युनियनले उद्योगमा तालाबन्दी गरिरहेका छन् । जसले लगानीको वातावरण बनाउनभन्दा पनि बिगार्ने काम गरिरहेको छ ।
सरकार राजनीतिक मुद्दामा अल्झिरहेकाले संविधान जारी हुँदा नै निजी क्षेत्रको विशेष चासो रहेका मुद्दामा प्रवेश गर्ने समय पाएको छैन । मुरारकाका अनुसार त उद्योगी–व्यवसायीका लागि झन् बितेको एक वर्ष नराम्रो भएको छ । संविधानमा लेखिएअनुरुप समाजवादउन्मुख अर्थतन्त्र कसरी अगाडि बढ्छ, त्यो निजी क्षेत्रको चासोको विषय रहिआएको थियो । तर, सरकारको क्रियाकलापबाट झन् त्यो अन्योलग्रस्त देखिएको छ ।
शोषणरहित समाज निर्माण गर्न राष्ट्रिय अर्थतन्त्रलाई आत्मनिर्भर, स्वतन्त्र तथा उन्नतिशील बनाउँदै समाजवादउन्मुख स्वतन्त्र र समृद्ध अर्थतन्त्र विकास गर्ने राज्यको आर्थिक लक्ष्य हुने नयाँ संविधानमा उल्लेख छ । निजी क्षेत्रलाई आश्वस्त पार्दै प्रमुख तीनवटै दलका नेताले संविधानमा जे लेखिए पनि हालकै खुला बजार अर्थतन्त्रअनुरुप नै अर्थतन्त्र अघि बढ्ने बाचा गरेका छन् । तर, त्यसको नीतिगत रूपमा अझै सम्बोधन भएको छैन ।
संविधानले अर्थ, उद्योग र वाणिज्यसम्बन्धी नीतिमा सार्वजनिक, निजी र सहकारी क्षेत्रको सहभागिता बढाउने र सहकारीलाई प्रवद्र्धन गर्दै राष्ट्रिय विकासमा अत्यधिक परिचालन गर्ने भने पनि विगतदेखि नै सहकारीको स्वेच्छाचारिताले अर्थतन्त्रमा असर परिरहेको छ । नयाँ सहकारी ऐन ल्याउन कोसिस गरिरहेका पूर्वमन्त्री चित्रबहादुर केसीको भनाइ मान्ने हो भने त सहकारी झन् सामन्तवादी जमिन्दारीतिर उन्मुख भइरहेको अवस्था छ । सरकारले नयाँ संविधान कार्यान्वयमा सहकारीको भूमिका तथा यसबाट नागरिकमा परेको नकारात्मक प्रभावलाई कसरी सामन्जस्य गर्छ, त्यो पनि हेर्न बाँकी छ ।
यस्तै, आर्थिक क्षेत्रका सबै गतिविधिमा स्वच्छता, जवाफदेही र प्रतिस्पर्धा कायम गर्न नियमनको व्यवस्था गर्दै सर्वांगीण राष्ट्रिय विकासमा प्रोत्साहन र परिचालन गर्ने, उपलब्ध साधन, स्रोत तथा आर्थिक विकास प्रतिफलको न्यायोचित वितरण गर्ने र तुलनात्मक लाभका क्षेत्र पहिचान गरी उद्योग विकास र विस्तारद्वारा निर्यात प्रवद्र्धन गर्दै वस्तु तथा सेवाको बजार विविधीकरण र विस्तार गर्ने नयाँ संविधानमा उल्लेख छ ।
तर, राजनीतिक संरक्षणमा नियामक निकायलाई कमजोर र पंगु बनाउने काम बन्द भएको छैन । बैंक तथा वित्तीय संस्थासम्बन्धी कानुनमा संशोधन तथा एकीकरण गर्न बनेको विधेयकमा सभासदबाट आफ्नो पद र ओहदा दुरुपयोग गरी प्रभाव पार्न अझै हरसम्भव प्रयास भइरहनु यसको ज्वलन्त उदाहरण हो ।
सरकार कसरी राजनीतिक आवरणमा मौलाएको छद्मभेषी निजी क्षेत्र र त्यसले सिर्जना गरेको कालोबजारी, कृत्रिम अभाव र कालोधन थुपार्ने होडबाजीलाई नियन्त्रण गरी संविधानमा लेखिएझैं राष्ट्रिय अर्थतन्त्रलाई प्रतिस्पर्धी बनाउन लागिपर्छ, त्यो हेर्न बाँकी छ । व्यापारिक स्वच्छता र अनुशासन कायम गरी उपभोक्ताको हित संरक्षण गर्ने तथा राष्ट्रिय अर्थतन्त्रको विकासका लागि राष्ट्रिय उद्योग–धन्दा र साधन स्रोतको संरक्षण र प्रवद्र्धन गरी नेपाली श्रम, सीप र कच्चा पदार्थमा आधारित स्वदेशी लगानीलाई प्राथमिकता दिने विषय पनि व्यवहारमै हेर्नुपर्छ ।
राजनीतिले अर्थतन्त्र डो¥याउने कि अर्थतन्त्रले राजनीति भन्ने बहस गर्न राजनीतिक दलले फुर्सद पाएका छैनन् । संविधानले राष्ट्रिय अर्थतन्त्रको विकासका लागि स्वदेशी लगानीलाई प्राथमिकता दिने, राष्ट्रिय हितअनुकूल आयात प्रतिस्थापन, निर्यात प्रवद्र्धनका क्षेत्रमा वैदेशिक पुँजी तथा प्रविधिको लगानी आकर्षित गर्दै पूर्वाधार विकासमा प्रोत्साहन एवं परिचालन गर्नेमा जोड दिने पनि उल्लेख गरेको छ । तर, त्यसअनुरुप ऐन, नियम तथा सरकारी नीति बन्ने र बनाउने काम नहँुदा लगानी कसरी बढ्छ र रोजगारी कसरी सिर्जना हुन्छ भन्ने प्रश्न अझै टड्कारो छ ।
गएको आर्थिक वर्ष विविध कारणले आर्थिक वृद्धिदर ०.७७ प्रतिशतमा खुम्चियो । देश झन् गरिबीतिर उन्मुख हँुदै छ । राजनीतिक दलका नेताले के बुझ्नु आवश्यक छ भने गरिब देशका नेताको कुनै पनि देशमा सम्मान हुन्न । त्यसैले अब छिटोभन्दा छिटो संविधान कार्यान्वयन गरेर राजनीतिक दल आफैँले वाचा गरेको आर्थिक समृद्धिको बाटो खोलेनन् भने उनीहरू आफ्नै पनि सम्मान कतै हुन्न ।

Government concerned over Indian blockade

Nepal has officially showed concern over 'India-imposed blockade' since last four days that has made the lives of Nepalis hard.
Foreign Ministry today – releasing a press note – said that the government is concerned over 'undue delay on the movement and clearance of cargo vehicles resulting in significant decrease in the flow of essential goods to Nepal from India via different border checkpoints for last few days.'
"It decreased flow has been noted particularly since September 23, whereas the security situation in Tarai has remained the same for more than a month and now has been improving gradually,” the ministry said in a statement.
Minister for Health and Population Khaga Raj Adhikari – who is officiating foreign
minister in an absence of foreign minister Mahendra Pandey – during his meeting with ambassador of India to Nepal at the Foreign Ministry in Singha Durbar yesterday, had informed about the fact and requested for necessary cooperation from Indian government for early release of cargo vehicles stuck at border checkpoints on the Indian side, according to the ministry.
A handful of vehicles – with perishable goods – were allowed to enter Nepal through Mechi and Dhangadhi check point. "Due to the blockade, Nepalis have begun to feel shortage of daily supplies on the eve of festive season,” the ministry said, further adding that as many as 29 cargo vehicles carrying perishable goods had managed to enter Nepal yesterday and the day before through Bhairahawa checkpoint.
The ministry also informed that 17 cargo vehicles, including three with petroleum products, through Mechi checkpoint and 25 cargo vehicles, including 20 with petroleum products, through Dhangadhi check point could enter Nepal, today.
"The situation of supply, however, has not improved ever since," it said, adding, "Not a single cargo vehicle could enter Nepal through Biratnagar, Birgunj, Bhairahawa, Krishnanagar and Nepalgunj checkpoints until 5 pm today."
India has – showing its displeasure over promulgation of constitution through Constituent Assembly (CA) on September 20 – blocked cargo vehicles, including petroleum products, despite agreement to supply petroleum products to Nepal Oil Corporation (NOC) by Indian Oil Corporation (IOC), the sole supplier of petroleum products to Nepal. India sent a 7-point recommendation to add in the constitution, which Nepali leaders rejected. The Indian bureaucracy has taken the issue as its prestige issue and entered into ego-war with a tiny landlocked neighbour Nepal.
"Hundreds of vehicles carrying petroleum products and other essential goods are awaiting clearance to enter Nepal on the Indian side of the border,” the statement added, “Tankers have not been filled up with petroleum products."
Large number of vehicles have not been allowed to enter the Indian side and due to which people in Nepali side have begun to feel shortage of daily supplies on the eve of festive season, the statement further read. "Given the friendly relations existing between the two countries, Nepal sincerely hopes that the India will take all necessary steps at the earliest to ensure uninterrupted entry of vehicles carrying essential supplies, including petroleum products, to Nepal as before. It also reiterated that there would not be any problem inside the Nepali territory for the transport vehicles and their personnel since arrangements are already in place for their security.
Though not permitting transit right to a landlocked country like Nepal is a breach of freedom of transit rights of landlocked countries. If India continues to impose embargo on Nepal, Nepal can lodge complaints in the multilateral trade mechanism as it is the right of landlocked country. The transit and free supply of consumables is Nepal’s right and India should facilitate it without any hindrance, according to the multilateral and bilateral agreement.

Government working on to reopen Tatopani, Rasuwagadhi customs

The government has started preparation to reopen the customs with the northern neighbour China due to problem on the southern border.
The two customs offices along Nepal-China border – Tatopani and Rasuwagadi – have not been operational since the April 25 earthquake. But the unrest in Tarai for the past one-and-a-half months and fresh 'blockade' enforced by India has forced the government to expedite the process to reopen the two customs offices on China border. "The festive season next month has also forced the government," according to Ministry of Supplies.
The Chinese government is positive about reopening both the customs offices by October 15," secretary at the Ministry of Commerce and Supplies Naindra Prasad Upadhyay told a parliamentary committee on commerce today morning. "We had discussion with the Chinese officials yesterday too," he said, adding that the northern neighbour is ready to help Nepalis get enough supplies for festivities. The festivals – Dashain and Tihar – fall in the last week of October and the first half of November this year.
The unrest created by the Tarai-Madhes parties and India's 'blockade' is sure to make the lives of Nepalis hard – also due to hike in rices of essential supplies – during the festivities.
The agitating Tarai-Madhesh parties today disrupted supplies from the southern plains to pile pressure on the government. However, they forgot that the blockade will only widen their distance with Kathmandu and other region, as their protest will create shortage before the festivals.
Likewise, India has also halted more than 1,000 oil tankers and trucks with essential supplies from entering Nepal to express its dissatisfaction with political parties who didn't take Indian recommendations for the constitution.
Though India's Ministry of External Affairs has said that the Indian government has not prescribed any recommendations, the Indian media published New Delhi's 7-point recommendations to Nepal government.
According to customs officials, around 1,500 oil tankers from India used to enter Nepal every day from the Jogbani Customs Office. But there has been no movement for the past three days, creating shortage in Nepal. Long queues have started forming at petrol pumps as people rush to fill tanks of their bikes and cars fearing prolonged shortage.
Meanwhile, Nepal Oil Corporation (NOC) has also requested people to use public vehicles to lessen demand for petroleum products.
Due to the disturbance in southern plains – where there are major customs points – since more than last one and half months, revenue mobilisation has plunged by 35 per cent in Bhadra – the second month of the current fiscal year 2015-16, according to the Department of Customs.

बन्दैछ समृद्धिको आधार

आकाश खसेन भने असोज ३ गते साँझ ५ बजे देशले नयाँ संविधान पाउनेछ। लगातार ८ वर्षको आरोह–अवरोहपछि असोज ३ गते संविधानसभाले संविधान जारी गर्ने मिति तोकेको परिप्रेक्ष्यमा नेपाली राजनीतिको एउटा अत्यन्तै तरल कालखण्डको पटाक्षेप भएकोमा निजी क्षेत्र उत्साहित छ। तर उनीहरू अझै पनि ढुक्क भने देखिन्नन्। मधेस आन्दोलन कसरी सुरक्षित अवतरण (सेफ ल्यान्डिङ) गर्छ र नयाँ संविधानको मूल्य, मान्यता तथा भावना अनुरूप ऐन कानुन कहिले बन्छन्, निजी क्षेत्रको अबको चासोको विषय भएको छ।
राजनीतिक दलहरूले हरेक पल्ट बहाना बनाउने संविधान पारित भएकोमा नेपाल उद्योग वाणिज्य महासंघका अध्यक्ष पशुपति मुरारका खुसी व्यक्त गर्छन्। 'अब देश आर्थिक मुद्दामा प्रवेश गर्छ,' उनी आस गर्छन्। असोज ४ गतेको विहान विगतका विहानभन्दा कुनै फरक नहोला तर, असोज ३ गते ५ बजेपछि नै नेपालले आर्थिक समृद्धितर्फको यात्रा सुरु गर्नेमा भने उनी विश्वस्त छन्।
विगत ६० वर्षदेखि संविधानसभाबाट संविधान बनाउने राजनीतिक माग पूरा गर्न एक पुस्ता सकिनै लाग्दा संविधानसभाले संविधान दिने पक्का भइसकेपछि अब राजनीतिक दललाई भने विगतमा जस्तो बहानाबाजी गर्ने मौका पक्कै रहने छैन। मुरारका पनि एउटा दस्तावेजले सबै समस्याको समाधान नगरे पनि आर्थिक समृद्धिको एउटा आधार तयार भएको मान्छन्। पक्कै हो, समाजमा रहेका केही असन्तुष्टि सम्बोधन गर्न पनि केही समय लाग्छ र ती असन्तुष्टि सम्बोधन पनि गर्नुपर्छ नै। तर, पनि अब नेपाल ६० वर्षे प्रसव बेदनाबाट मुक्त भएर समृद्धिको बाटोतिर पाइला चाल्नुको कुनै विकल्प भने छैन।
यसबीचमा राजनीति दलले पनि संविधानसभा वा संविधान लक्ष्य होइन तर लक्ष्यमा पुग्ने संवैधानिक दस्तावेज हो भन्ने कुरा सबैलाई बुझाउनु आवश्यक छ। केही समय पक्कै लाग्ला। तर, अब विभिन्न बहानामा आन्दोलन गरेर देशलाई अगाडि बढ्नबाट रोक्ने कुनै पनि विकल्प राजनीतिक दल वा तिनका नेतासँग रहने छैन।
तराई–मधेस वा अन्य समुदायको असन्तुष्टि बढ्नुका पछाडि जतिसुकै राजनीतिक कारण भए पनि ती सबैका जरोमा आर्थिक स्वतन्त्रता र व्यक्तिको आर्थिक उपार्जनका अवसरमा पहुँच नै हो। नेपाल उद्योग परिसंघका वरिष्ठ उपाध्यक्ष हरिभक्त शर्माका अनुसार पनि सबै नेपाली जनताको चाहना भनेको समृद्धि नै हो। सबैले चाहेको सुख, शान्ति तथा काम गरेर खान पाउने वातावरण नै हो। 'त्यसको लागि अर्थतन्त्र सबल हुनुपर्योल,' शर्मा भन्छन्।
तर, आर्थिक स्वतन्त्रता र आर्थिक उपार्जनका अवसरमा सबै नागरिकको पहुँच बढाउन असोज ४ गतेपछिका सरकारले कसरी आफूलाई प्रस्तुत गर्छन्, त्यसैबाट नेपालको भविष्य कता जान्छ भन्ने ठोकुवा गर्न सकिन्छ। राजनीतिक दलहरूले नयाँ संविधान बोकेर गाउँगाउँसम्म जाने र जनताका उपलब्धि बताएर उनीहरूलाई राजनीतिक स्वतन्त्रतासँगै आर्थिक स्वतन्त्रताको जगमा नयाँ नेपालको मार्गचित्र कोर्न सघाउने काम गर्नु आवश्यक छ।
निजी क्षेत्रको विचारमा पनि राजनीतिक दलले जनतालाई नयाँ संविधानमा रहेका उपलब्धिबारे सचेत गराएर आर्थिक क्रान्तिको बाटो समाउन उत्प्रेरित गर्न सके देशले कायापलट गर्न धेरै दशक कुर्नुपर्दैन।
विकासका पण्डितहरूका अनुसार एउटा राष्ट्र विकास हुन प्राकृतिक स्रोत–साधन, मानव संशाधन तथा पुँजी आवश्यक हुन्छ। राष्ट्र विकास गर्न चाहिने तीन प्रमुख तत्वमध्ये नेपालमा दुई तत्व भरपूर रूपमा उपलब्ध छ। नेपालको जनगणना २०६८ अनुसार ५० प्रतिशतभन्दा बढी १५ देखि ३५ वर्षका उत्पादनशील एवं ऊर्जावान युवा भएको देश हो, नेपाल। हाल बढ्दो बेरोजगारीका कारण युवाहरू वैदेशिक रोजगारीमा पलायन भइरहेका छन्।
त्यस्तै, नेपालमा प्रचूर मात्रामा प्राकृतिक स्रोत–साधन पनि उपलब्ध छन्। नेपालमा तत्काल लगानीका लागि पुँजी नभए पनि ठूला आयोजनामा लगानी गर्न वैदेशिक लगानीकर्ता तयार छन्।
आइतबार संविधान जारी भएमा सबैभन्दा बढी खुसी वैदेशिक लगानीकर्ता हुनेछन्। किनकि उनीहरूमा नेपालमा संविधान बनोस र लगानीको वातावरण बनोस भन्ने चाहाना नेपालीको भन्दा बढी छ।
तसर्थ, असोज ४ गतेको बिहान यस अर्थमा पनि विशेष हुनेछ कि विगतको शताब्दिदेखि नै ३.५ प्रतिशतको न्यून आर्थिक विकासको घङघङीमा रुमल्लिरहेको नेपालका लागि ६ प्रतिशतभन्दा माथिको आर्थिक वृद्धिको सपना साकार पार्न सामान्य हुने पक्का छ। जसका कारण नेपाल हालको अल्पविकसितबाट विकासशील राष्ट्रको श्रेणीमा उक्लन सहज हुने छ। राष्ट्रिय योजना आयोगले नेपाललाई सन् २०२२ सम्ममा विकासशील राष्ट्रको श्रेणीमा उकाल्ने प्रतिबद्धता पनि जनाएको छ।
मुरारकाका अनुसार आर्थिक उपार्जनमा जनताको प्रत्यक्ष सहभागिताको र लगानीको सुरक्षाको प्रत्याभूति हुनासाथ देशले आर्थिक रूपमा फड्को मार्ने निश्चित छ। आर्थिकरूपमा अवसर प्राप्त गरेको खण्डमा असन्तुष्ट वर्ग तथा पिछडिएका समुदाय पनि राष्ट्रिय मूलधारमा आउनेछन्। र, आफ्नो आर्थिक स्थिति सुदृढ हुनासाथ उनीहरुलाई आफू शोषित, पीडित एवं अपहेलित महसुस हुन ेछैन। जसका कारण राष्ट्रिय एकता र अखण्डता झन् बलियो हुनेछ।
शर्मा पनि असोज ३ गतेको दिनले नेपाललाई एउटा समृद्ध, शान्त र अखण्ड राष्ट्रको रूपमा विकसित हुने आधार तयार गर्नेमा ढुक्क छन्। उनका अनुसार नेपाल अब यथास्थितिमा रहने छैन र बरु दक्षिण एसियाको उदाउँदो अर्थतन्त्रको रूपमा एक दशकभित्रै आफ्नो पहिचान बनाउन सक्षम हुनेछ।

Indefinite strike bleeding economy blue

Private sector representatives asked for security of their properties and end to indefinite strikes that has crippled the country since last one month bleeding the economy blue.
Federation of Nepalese Chambers of Commerce and Industry (FNCCI) said that the indefinite strike in Tarai is posing more risk to economy than the damage caused by devastating earthequake of April 25.
Briefing Prime Minister Sushil Koirala at his official residence Baluwater, today the delegation led by FNCCI president Pashupati Muraraka, said that the country’s business sector is sustaining daily losses of around Rs 20 million due to Tarat unrest.
Likewise, traders are forced to incur loss as cargo trucks have been left stranded leaving businesses with no option than to pay detention and demurrage charge, apart from other fines. According to study, a day of bandh causes the country loss of Rs 2.5 billion. The country has already lost around Rs 90 billion in last one month, which is almost equal to a year's export receipt.
Muraraka, on the occasion, also briefed the premier of private sector's request to the agitating parties. The economy is bledding blue, and the agitators are not giving ear to private sector, he said, asking Koirala to be serious. He also requested to create a business friendly environment and deliver confidence to the entrepreneurs for operating industrial establishments.
There has been increase in number of attacks against private properties and industrial establishments in the Tarai region, including incidences of protestors hurling petrol bombs and vandalising factory installations. They also asked the government to provide needful security to traders and their businesses during the time of bandhs and strikes.
Finance minister Dr Ram Sharan Mahat, minister for Physical Infrastructure and Transport Bimalendra Nidhi, and minister for Forest and Soil Conservation Mahesh Acharya were also present at the meeting.
Prime Minister Koiral, on the occasion, asked the delegation to submit a written suggestion on what they seek from the government. "The government is committed to help businesses and industries withsand such adverse environment," Koirala said, adding that the government is working tirelessly to address political demands raised by various groups and parties regarding the constitution drafting process.
He also informed the privatesector that the major parties have decided to slow down the constitution writing process in order to take disgruntled parties on board.
The government has however failed to control criminal activites in Tarai in the name of politics. The increasing politicisation of criminal activities in the Tarai in the last one month is not going to help solve the issues of Tarai and tarai Madhesh people, rather the region will be famous for gruesome killings and murders of security personals. Some politicisna might benefit from increasing impunity but most of the Tarai people will get nothing as they will continue to be deprived of opportunities for a decent life.

Constitution sans economic freedom will ignite conflict

Economists and entrepreneurs have said that constitution sans economic freedom will fuel social unrest in the country.
Asking lawmakers to replace 'socialism' in the draft constitution to avoid another conflict, they claimed that the country will see another revolution - due to increased rich-poor gap - if the economic issues in draft constitution are approved as it is.
The constitution must ensure economic freedom to every citizen, if the country aspires to become prosperous, according to president of Federation of Nepalese Chambers of Commerce and Industry (FNCCI) Pashupati Muraraka.
"Instead of socialism-oriented economy, the constitution must clearly spell liberal market economy," he said, adding that the draft has to replace 'socialism' with 'liberal economy' that can ensure greater economic freedom by creating opportunity and an improved quality of life. He further added that economic freedom will ensure right to choose how to produce, sell, and use your own resources respecting others' rights to do the same. "Only the economic freedom can drive the nation to prosperity."
Without engaging a person in production, a country cannot transform economically. For a person to engage in economic activities freely, the constitution must ensure economic freedom. The countries that are economically developed have adopted economic freedom ensuring the involvement of their citizens in production and sale. That has not only increased their income, but also improved their living standard and overall human development.
However, the draft has, by spelling socialism, back-tracked the liberal economic orientation that the country has been practicing post-1990, Muraraka suspected. As the draft constitution has repeatedly highlighted cooperatives instead of encouraging private sector, his doubt could be genuine. The private sector is indeed suspicious on what the political parties are by giving up the time-tested liberal economic policy.
The draft has created confusion by stating 'socialism-oriented economy' and private sector too, according to economist KeshabAcharya. Saying that the draft has mixed both private sector and socialism, creating more confusion, he said that the political parties might have made 'socialism' a meeting point as they follow different ideology. "It might have made their task easy, but country will have to pay for their convenience."
He suggested replacing 'socialism' with 'welfare state with economic freedom' that cannot only save from wasting many pages in the constitution but also clarifies where the nation is heading toward.
Nepal Chambers of Commerce (NCC) President Rajesh Kazi Shrestha also opined that the draft has undermined private sector as it gives priority to cooperatives and socialism.
Likewise, Confederation of Nepalese Industries (CNI) president Narendra Basnyat said that only the private sector-friendly constitution can institutionalise political achievements and economic development.
National Planning Commission (NPC) member Dr Chandra Mani Adhikari seconded his thought. "Leaders from different political ideologies have compromised on socialism without defining it," he said, adding, "Since there is problem in both liberal market economy and socialism, the word 'socialism' should be replaced with 'progressive capitalism." Otherwise, it will create more confusion, he added.

Bandhs deny people their fundamental rights; strikes bleed economy white, curtailing freedom to work, movement



The season of bandhs and strikes is back again, curtailing people's right to work and movement, which is not only against the Constitution, but also bleeding the economy white.
"Bandh is the height of criminalisation in politics," according to rights activist Jyoti Baniya.
"Our Constitution has ensured people's right to movement and right to work as fundamental human rights," he said, adding that curtailing these rights is not only against the Constitution, but also against the State and the society.
The culture of taking citizens hostage by calling bandhs and strikes to climb to the seat of power is a gross violation of human rights, added Baniya, who had filed a case at the Supreme Court asking it to ban bandhs. "The Supreme Court had also banned bandhs."
"Though strikes are a right to collective bargaining, one cannot curtail others rights while exercising their own rights," he added.
Apart from our Constitution that has guaranteed the right to work and movement, Nepal is party to the International Covenant on Economic, Social and Cultural Rights (ICESCR) that is a multilateral treaty adopted by the United Nations General Assembly on December 16, 1966, and in force from January 3, 1976. It commits its parties to work towards granting of economic, social, and cultural rights to individuals and is monitored by the UN Committee on Economic, Social and Cultural Rights.
With the formation of a new government to hold elections, fringe parties have been protesting, taking hostage civil liberties to bargain for power.
However, they have denied the right of the people to work for their livelihood.
The right to work is a concept that people have a human right to work, or engage in productive employment, and may not be prevented from doing so, Baniya quoted the international law, adding that the right to work is enshrined in the Universal Declaration of Human Rights and recognised in international human rights law through its inclusion in the ICESCR, where the right to work emphasises economic, social and cultural development.
At a time when the country is failing to create employment opportunities, forcing a majority of the youth to flock to the deserts of the Middle East, frequent bandhs and strikes have hit industries as they have not been able to operate to their full capacity.
The country is projected to witness the lowest economic growth in six years in the current fiscal year at 3.56 per cent, according to the Central Bureau of Statistics that has painted a bleak picture of manufacturing and agriculture — both engines of domestic economic growth.
The private sector — that generates the largest employment — is hit hard by bandhs and strikes, said president of Federation of Nepalese Chambers of Commerce and Industry Suraj Vaidya. "Industries are forced to shut down," he said, adding that frequent bandhs are bleeding the economy white
According to an estimate, a day of bandh costs the country around Rs two billion. "Even an hour of bandh will cost around Rs 83 million," according to the estimation.
"Bandhs are not a solution to any problem," Vaidya added.
People can exercise their right through other means of non-violent forms of protests, where they won't be hurting other's personal freedom and rights.
Without economic freedom, the country cannot prosper and develop, he added.
 
The universal declaration
* Article 23 of The Universal Declaration of Human Rights states that 'everyone has the right to work, to free choice of employment, to just and favourable conditions of work and to protection against unemployment.'
* Human rights can be classified and organised in a number of different ways. At an international level, the most common categorisation of human rights has been to split them into civil and political rights, and economic, social and cultural rights.
